Information Request – Todrig
Your Request
Please could you provide all correspondence, forms, maps consultation reports and all other documents between NatureScot and:
(a) Scottish Forestry
(b) any other individual or organisation
in relation to the Todrig woodland creation scheme, near Ashkirk in the Scottish Borders, reference 25FGS84239 since 19 March 2025.
NatureScot has already provided a FOI response for information from a request made on 19 March 2025. As I am only requesting information since 19 March 2025, the amount of information required should be relatively small.
Please could you ensure that the consultation response by NatureScot is provided for the formal public consultation (announced by Scottish Forestry) that started on or around 4 March 2025. Please ensure that the date this response was made is provided, and please ensure all correspondence and dates of anything relating to the consultation is provided in the form of original emails.
Our Response
Following a search of the information we hold our response is attached separately. Although technically in scope we have not included our last FOI response to you in the attached information, as you refer to it in your above request.
We have marked out (redacted) sensitive species information, e.g. nesting site locations. As release of information under the EIRs is a release into the public domain, we do not believe that it is in the public interest to release information that might enable disturbance to these species. We are therefore applying EIRs Regulation 10(5)(g) – Protection of the environment.
We have also redacted personal data in the documents provided. Releasing the personal data into the public domain in response to an access to information request would breach the Data Protection Act 2018. We are therefore withholding the information under EIRs Regulation 11(2) (Personal data).
To note, some information was provided to us in a partially redacted form, so we do not hold this information and have therefore not withheld it.
How We Handled Your Request
We believe you have asked for environmental information as defined in the Environmental Information (Scotland Regulations 2004 (‘the EIRs’), so we are dealing with your request under those regulations. To be able to use the EIRs, we must apply an exemption under section 39(2) of the Freedom of Information (Scotland) Act 2002 (‘FOISA’). The Scottish Information Commissioner’s guidance recommends that public authorities apply this exemption to environmental information and handle request under the EIRs.
