During our email exchanges you also asked if there was any information relating to the following:
“.. and James Bunyan in reference to the development at the House of Rosskeen, Invergordon, planning ref 23/05466/FUL and limiting to the timeframe from June 2023 to present?
Our Response
We have discussed your request with our Operations and Licensing Teams, and we have also asked a member of staff who was originally with the Operations Team, and who had been involved in 23/05466/FUL, to undertake additional searches and this member of staff found two further documents, which we have provided with this response, however, it would appear to be a complaint from a member of the public which was received and responded to.
We received a request previously under FOI relating to House of Rosskeen, Invergordon and/or planning application 23/05466/FUL and a copy of the information released under that previous request is provided again with this response.
Information that has been found relating to 17/04318/SCRE is also attached separately to this response.
We have removed personal data from the new information being released to you, because releasing personal data into the public domain, in response to a freedom of information request would go against the Data Protection Act 2018, so we have applied the exemption 11(2)(Personal data) to that information.
For part 2 of your request, we undertook further searches relating to James Bunyan and House of Rosskeen, Invergordon, using the following search parameters:
− Document Search 1 for documents created between the 1 June 2023 to 28 March 2025 that contains the name James Bunyan and House of Rosskeen – No Information found
− Document Search 2 for documents created between the 1 June 2023 to 28 March 2025 that contains the name James Bunyan and planning reference 23/05466/FUL – No information found
− Document Search 3 for documents created between the 1 June 2023 to 28 March 2025 that contains the name James Bunyan and planning reference 23/05466/FUL and House of Rosskeen – No information found
Additional searches undertaken by our Licensing Team, also came back with no information found.
As we do not hold the information for this part of your request, we must apply the following exemption 10(4)(a)(Information not held).
We have also redacted out information that is out-with the scope of your request as it deals with other sites.
How We Handled Your Request
We believe you have asked for environmental information as defined in the Environmental Information (Scotland Regulations 2004 (‘the EIRs’), so we are dealing with your request under those regulations. To be able to use the EIRs, we must apply an exemption under section 39(2) of the Freedom of Information (Scotland) Act 2002 (‘FOISA’). The Scottish Information Commissioner’s guidance recommends that public authorities apply this exemption to environmental information and handle request under the EIRs.
