Information Request – Carmyle/Kenmuir Farm Development
Your Request
We are seeking any environmental reports, surveys, consultations, correspondence or records held by NatureScot in relation to the proposed development at Carmyle/Kenmuir Farm, Glasgow, a site currently zoned as greenbelt land and recently announced by Glasgow City Council for potential sale to private developers for residential housing (approx. 400 homes).
Unfortunately, the Glasgow City Council planning portal is currently offline, making it difficult for us to access any related documentation or planning application records.
We would be grateful for any information you can provide or guidance on how we may formally request access to relevant records.
To assist in locating the information, we provide the following details:
• Time period: January 2014 to present
• Location: Carmyle/Kenmuir Farm, Glasgow, G32
• Specific project or issue: Proposed housing development and sale of greenbelt land by Glasgow
City Council at Carmyle/Kenmuir Farm; potential environmental impact; presence of protected species or habitats
We are particularly interested in:
• Any Environmental Impact Assessments (EIAs) or species/habitat surveys
• Records of internal or external consultations or correspondence
• Any records of discussion regarding licences for works impacting protected species or habitats
Our Response
We have discussed your request with our Operations Team; they found many documents that meet the terms of your request. Copies of these documents are provided separately to this response.
We have marked out redacted some information within these documents for the following reasons.
Personal Data – We have redacted out personal data, including names, from this information because to release this information in response to an information request, would go against the Data Protection Act 2018. We have therefore applied the EIR exemption 11(2) (Personal Data).
Sensitive Species Data – We have also redacted out information relating to otter holts and badger setts. We have done this because releasing this information could increase the risk of deliberate disturbance to these mammals. As the release of information under the EIRs is equivalent to release into the public domain, we do not believe that it is in the public interest to release information that might enable disturbance of these mammals. We have therefore applied the EIRs exemption 10(5)(g) (Protection of the environment) to this information.
How We Handled Your Request
We believe you have asked for environmental information as defined in the Environmental Information (Scotland Regulations 2004 (‘the EIRs’), so we are dealing with your request under those regulations. To be able to use the EIRs, we must apply an exemption under section 39(2) of the Freedom of Information (Scotland) Act 2002 (‘FOISA’). The Scottish Information Commissioner’s guidance recommends that public authorities apply this exemption to environmental information and handle request under the EIRs.
