Our Response
NatureScot has not developed a species protection plan or code of practice for the Loch Ness Monster. This means that EIRs Regulation 10(4)(a) (Information not held) applies to your request for the information.
In 2018, NatureScot engaged in some media around the development of a code, but it was intended as a light-hearted response to a similar query at the time. It suggested that individuals and organisations with an interest in Loch Ness could get together to develop a Code of Practice. We are not aware of any Code having been developed.
How We Handled Your Request
We believe you have asked for environmental information as defined in the Environmental Information (Scotland Regulations 2004 (‘the EIRs’), so we are dealing with your request under those regulations. To be able to use the EIRs, we must apply an exemption under section 39(2) of the Freedom of Information (Scotland) Act 2002 (‘FOISA’). The Scottish Information Commissioner’s guidance recommends that public authorities apply this exemption to environmental information and handle request under the EIRs.
