Our ref: SIR181735/A5502073
Information Request – Private Water Supply near Cruden Bay Oil Facility
Your Request
I would like to request details of current private water supply (PWS) information held by Nature Scot. I would like information on PWS located within 10 km of the Cruden Bay Oil Reception Facility located in Whinnyfold, Aberdeenshire. The approximate grid reference is NK 07133 33071 (approximate Site Centre).
Our Response
We have discussed your request with the Operations Team who deal with that area.
Searches of the information the Operations Team hold for that area returned no records of anyone with water extraction rights from any of the designated sites within 10 km of the grid reference provided. NatureScot would not hold information on private water supplies outside of designated areas.
If you want to discuss your request further with NatureScot, please contact our Operations – North team.
As NatureScot does not hold the information that you have requested, we must, under the EIRS, apply the exemption 10(4)(a) (Information not Held) to your request.
All private water supplies must be registered with the local authority, see the link from Aberdeenshire Council's web page
If you contact [email protected] they may be able to provide you with the information you are seeking.
How We Handled Your Request
We believe you have asked for environmental information as defined in the Environmental Information (Scotland Regulations 2004 (‘the EIRs’), so we are dealing with your request under those regulations. To be able to use the EIRs, we must apply an exemption under section 39(2) of the Freedom of Information (Scotland) Act 2002 (‘FOISA’). The Scottish Information Commissioner’s guidance recommends that public authorities apply this exemption to environmental information and handle request under the EIRs.
If you would like to find out more about the access to information legislation, there is a guidance booklet available on the Scottish Information Commissioner’s website.
