Information Request – Moray Flow Park Moray Firth SAC
Your Request
Was NatureScot consulted regarding the potential impact of the recent sonic surveys of the Moray Firth SAC as part of the Moray Flow development? Please provide a copy of NatureScot's response. I note in the June 2025 guidance on this SAC that such survey would be disturbing to the designated features.
Our Response
We have discussed your request with our Supporting Good Development Team, and they have confirmed that NatureScot was consulted, and a copy of our response is attached separately.
We have redacted personal data from this document, under the EIRs exemption 11(2)(Personal Data), releasing personal data in response to an information request would breach the Data Protection Act 2018.
How We Handled Your Request
We believe you have asked for environmental information as defined in the Environmental Information (Scotland Regulations 2004 (‘the EIRs’), so we are dealing with your request under those regulations. To be able to use the EIRs, we must apply an exemption under section 39(2) of the Freedom of Information (Scotland) Act 2002 (‘FOISA’). The Scottish Information Commissioner’s guidance recommends that public authorities apply this exemption to environmental information and handle request under the EIRs.
