Information Request – Kirkcudbright Bird Flu
Your Request
Please share any communications, reports and other materials held about the bird flu outbreak and control zones imposed around Kirkcudbright in 2023.
Please ensure any communications are dated and displayed in chronological order, that media such as images and video are included, and all forms of communications, including Whatsapp, are provided.
Our Response
NatureScot has no role in the identification or management of Control Zones, and we have no communications or reports to share on this.
Scottish Ministers, on the advice from the Chief Vet, have responsibility for the implementation of controls regarding Avian Influenza. Information about how to submit an FOI to the Scottish Government is available at this link.
This means that EIRs Regulation 10(4)(a) (Information not held) applies to your information request.
How We Handled Your Request
We believe you have asked for environmental information as defined in the Environmental Information (Scotland Regulations 2004 (‘the EIRs’), so we are dealing with your request under those regulations. To be able to use the EIRs, we must apply an exemption under section 39(2) of the Freedom of Information (Scotland) Act 2002 (‘FOISA’). The Scottish Information Commissioner’s guidance recommends that public authorities apply this exemption to environmental information and handle request under the EIRs.
