Are the Men of Ness that you gave permission to kill the birds a registered company with HMRC? Assume you checked this before commencing given you are largely taxpayer funded thus accountable to us public?
Or are Men of Ness just what exactly?
Our Response
We cannot offer an opinion as to whether the applicant is a Registered Company or not, that would be for HMRC to confirm.
NatureScot issues licences to a named individual who could be representing a wide range of organisational types. The Wildlife & Countryside Act does not require NatureScot to consider the type of organisation as part of our assessment process and so we are not required to check if the applicant is a Registered Company.
How We Handled Your Request
We believe you have asked for environmental information as defined in the Environmental Information (Scotland Regulations 2004 (‘the EIRs’), so we are dealing with your request under those regulations. To be able to use the EIRs, we must apply an exemption under section 39(2) of the Freedom of Information (Scotland) Act 2002 (‘FOISA’). The Scottish Information Commissioner’s guidance recommends that public authorities apply this exemption to environmental information and handle request under the EIRs.
