Your Request
‘Number of accidents/incidents recorded caused by the operation/use of chainsaws by NS/SNH staff, volunteers and contractors over the last 5 years.

Our Response
Following a search of the information we hold our response is below.
1. Number of accidents/incidents recorded caused by the operation/use of chainsaws by NS/SNH staff, volunteers and contractors over the last 5 years.
There has been one incident over the last 5 years.
2. The severity/impact of injuries caused by the use of chainsaws over the last 5 years.
There were no injuries. The incident referred to in response to Question 1 was a near-miss.
3. The results of any internal investigations into accidents/incidents caused by the operation of chainsaws by NS/SNH staff/volunteers/contractors.
We have withheld this information as it could indirectly identify a third party. Releasing personal data into the public domain in response to an access to information request would breach the Data Protection Act 2018. We are therefore withholding the information under 11(2) (Personal Data) of the EIRs.
4. The number of RIDDOR reports submitted to HSE as a result of accidents/injuries caused by chainsaws over the last 10 years.
There have been no RIDDOR reports submitted by NatureScot over this period.
How We Handled Your Request
We believe you have asked for environmental information as defined in the Environmental Information (Scotland Regulations 2004 (‘the EIRs’), so we are dealing with your request under those regulations. To be able to use the EIRs, we must apply an exemption under section 39(2) of the Freedom of Information (Scotland) Act 2002 (‘FOISA’). The Scottish Information Commissioner’s guidance recommends that public authorities apply this exemption to environmental information and handle request under the EIRs.
