Public sector equality duty

Scottish public bodies are bound by the public sector equality duty that came into force on 5 April 2011.

Under the Equality Act 2010, NatureScot has a general duty to:

  • eliminate unlawful discrimination
  • advance equality of opportunity
  • foster good relations

Scottish Ministers also set public bodies in Scotland specific duties to help us to meet the general duty. These came into force on 27 May 2012.

Our specific duties are to:

  • report on mainstreaming the equality duty
  • publish equality outcomes and report on progress
  • assess and review policies and practices
  • gather and use employee information
  • publish gender pay gap information
  • publish statements on equal pay
  • consider award criteria and conditions in relation to procurement
  • publish in a way that’s accessible
  • promote Board diversity and publish the gender breakdown of the Board

The last of these duties was introduced in 2016, by the Equality Act 2010 (Specific Duties) (Scotland) Amendment Regulations 2016
