Complying with the biodiversity duty

Every public body in Scotland is required to produce a publicly available report, once every three years, on compliance with the biodiversity duty. This requirement is laid out in the Wildlife and Natural Environment (Scotland) Act 2011 (commonly known as the WANE Act), which came into force on 1 January 2012.

The report must outline the actions that you have taken to further the conservation of biodiversity while carrying out your public body’s day-to-day functions.

Your reporting will help to show:

  • that you are delivering the biodiversity duty
  • evidence of a socially responsible attitude to the way you are conducting your business
  • the contribution you are making towards sustainable development and quality of life issues
  • the contribution you are making towards Scottish Government targets identified in the Scottish Biodiversity Strategy and the accompanying Route Map, where these are relevant to your public body’s remit.

Create your biodiversity report

The Scottish Government has produced guidance on reporting on the biodiversity duty.

Here, you’ll find a suggested template, which you can use as a guide to presenting your report. Alternatively, you can incorporate your report as part of another document that you already produce. The guidance also includes a diverse range of example actions that different public bodies have reported on. What’s more, SNH has published various case studies from both local authorities and other types of public bodies on the actions they have taken.
