Restoration order

Restoration orders specify work needed to restore, as far as reasonably practicable, damaged natural features to their former condition.

Restoration orders are a form of criminal penalty imposed by the courts.

They may be used on individuals guilty of intentional or reckless damage to the protected natural features of either a:

Restoration orders are made under the provisions of Section 40 of the Nature Conservation (Scotland) Act 2004

A restoration order may be used in addition to any fine applied by a court.

Failure to comply with a restoration order without reasonable excuse is an offence.

Further, NatureScot may carry out the required works and recover our costs from the individual on whom the order was imposed.
